(POLITICO) A federal judge got it wrong last week when he claimed President Barack Obama indicated that the changes he ordered to immigration policy late last year left immigration officials without discretion about how to handle specific cases, the Justice Department argued in a federal appeals court filing Tuesday.
“The district court misconstrued the President’s remarks, which do not suggest that the policies divest officers of case-by-case discretion,” Justice Department lawyer Scott McIntosh wrote in a letter sent to the 5th Circuit U.S. Court of Appeals. “The opposite is true.”
In an opinion last week, U.S. District Judge Andrew Hanen said Obama’s comments at a Feb. 25 Telemundo town hall meeting confirmed one of the bases for the judge’s February order blocking the latest round of immigration executive actions. The judge’s injunction was based in part on his conclusion that immigration officers had no choice but to comply with Obama’s directives.
